Notwithstanding the arbitration agreement set forth above, either party may seek emergency injunctive relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information pending the resolution of any arbitration. This exception does not waive either party's right to demand arbitration of the underlying dispute.
